1. Agreement to Terms
By accessing or using the website nashair.net and services provided by Nash Heating & Air Conditioning ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. Nash Heating & Air Conditioning provides HVAC installation, maintenance, repair, and related services throughout San Diego County. All services are subject to availability and our acceptance of your service request. We reserve the right to refuse service to anyone for any reason at any time.
3. Quotes and Estimates
Quotes and estimates provided through our website or other channels are preliminary and subject to change based on on-site assessment. Final pricing will be confirmed before work begins. Quotes are valid for 30 days from the date of issue unless otherwise specified. We reserve the right to modify quotes if conditions differ from those initially described or assessed.
4. Scheduling and Cancellations
Appointments are scheduled based on availability and must be confirmed by our office. If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. We reserve the right to charge a cancellation fee for appointments cancelled with less than 24 hours notice or for missed appointments.
5. Payment Terms
Payment terms will be specified in your service agreement or invoice. Generally:
- Payment is due upon completion of service unless other arrangements have been made in writing
- We accept cash, checks, and major credit cards
- For installation projects, a deposit may be required before work begins
- Late payments may be subject to interest charges and collection costs
- Accounts more than 30 days past due may be subject to collection proceedings
6. Warranties
We warranty our workmanship for a period of one year from the date of service completion. Equipment and parts warranties are provided by the manufacturer and are subject to the manufacturer's terms and conditions. Our warranty does not cover damage caused by misuse, neglect, accidents, alterations, or failure to maintain equipment according to manufacturer specifications.
7. Limitation of Liability
To the fullest extent permitted by law, Nash Heating & Air Conditioning shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services. Our total liability for any claim arising out of or relating to our services shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Customer Responsibilities
As a customer, you agree to:
- Provide accurate and complete information regarding your service needs
- Ensure safe and clear access to work areas
- Ensure pets are secured during service visits
- Inform us of any known hazards or special circumstances
- Maintain equipment according to manufacturer recommendations between service visits
- Notify us promptly of any concerns or issues with completed work
9. Emergency Services
Emergency services may be available outside of normal business hours and are subject to additional charges. Emergency service rates will be communicated to you before work begins. Response times for emergency services are approximate and may vary based on technician availability and weather conditions.
10. Permits and Approvals
When required by law, we will obtain necessary permits for HVAC installations and major modifications. Permit costs will be included in your quote or invoice. You are responsible for obtaining any homeowner association or other property-related approvals that may be required.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Nash Heating & Air Conditioning or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content from our website without our express written permission.
12. Indemnification
You agree to indemnify and hold harmless Nash Heating & Air Conditioning, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of our services or violation of these Terms and Conditions.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, or equipment failures.

Any disputes arising out of or relating to these Terms and Conditions or our services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association. The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs.
15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising out of these terms must be brought in the state or federal courts located in San Diego County, California.
16. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
17. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after changes are posted constitutes your acceptance of the modified terms.
